By browsing or participating in the competitions on this website, the Participant (“Participant”) agree to be bound by these Terms and Conditions as amended from time to time. To the maximum extent permitted by law, neither of EB Productions, nor any of their respective employees, makes any express or implied representation or warranty about, or will be liable to the Participant or any other person for, any loss or damage (whether direct, indirect, consequential or economic), however caused and whether by negligence or otherwise, in connection with, this website, its use, its content or any competitions referred to on this website.

This includes (but is not restricted to) loss or damage the Participant might suffer as a result of any of the following:

(a) the Participant’s reliance on the completeness, accuracy, suitability or currency of the website or its content;

(b) failure or delay of performance or in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorized access to records; and

(d) defamatory, threatening, offensive or unlawful conduct of third parties.

EB Productions does not represent that any information (including any file) obtained from or through this website is free from computer viruses or other faults or defects. It is the Participant’s responsibility to scan any such information for computer viruses.

EB Productions shall have the right to terminate any Participant’s use of this website if EB Productions, in its sole discretion, determines that the Participant has breached the Terms and Conditions or engaged in any conduct which EB Productions, in its sole discretion, determines to be unacceptable.

Unless otherwise indicated, copyright in the information on this website is owned by EB Productions. All rights reserved. This site (including but not limited to images, illustrations, audio clips, video clips, and any other audio-visual material), or any portion of this site may not be reproduced, duplicated, copied, sold, re-sold or otherwise exploited for any commercial purpose that is not expressly permitted by EB Productions.

The Participant may download a single copy of the information on this website and, where necessary for its use as a reference, keep a temporary copy in the Participant’s computer's cache and make a single hard copy of that information. Except as permitted under the Copyright Act 1968 (Cth) or other applicable laws, no part of the information contained on this website may be otherwise reproduced, adapted, performed in public or transmitted in any form by any process (graphic, electronic or mechanical, including further copying, recording, taping or by a storage and information retrieval system) without the specific prior written consent of EB Productions.

A Participant shall not upload, post or otherwise publish any material which is protected by copyright or trademark law without the express permission of the owner of such copyright, trademark or other proprietary right.

Competitions

When the Participant enters into any competition on this website the personal information collected by EB Productions will be handled in accordance with the Privacy Policy outlined below.

Any stories, ideas, drawings, opinions or other material (“Material”) which the Participant submits to this site in the course of entering a competition becomes the sole, exclusive and unencumbered property of EB Productions. In the act of submission the Participant expressly consents to EB Productions utilizing the Material in any way it sees fit throughout the world in perpetuity. The Participant also releases and indemnifies EB Productions in respect of any and all claims or liability which may arise in connection with its use of the Material.

The Participant understand that the Participant’s participation in any and all competitions on this site does not occasion any special relationship (including but not limited to any confidential, fiduciary, implied, or contractual relationship) between EB Productions and the Participant.

Participation in Forums

A Participant shall not post or transmit through this website any defamatory, discriminatory, threatening, harmful, pornographic or other offensive material that would in any way violate the rights of others, or occasion any criminal or civil liability.

EB Productions is a production company only and not a publisher of the Chat Room or Forum content which is supplied by Participants, except to the extent that EB Productions may occasionally respond to such posts. EB Productions shall not be responsible for monitoring, editing or censoring such content and exercises no more editorial control than would any other distributor of content.

Notwithstanding, EB Productions reserves the right, but not the responsibility, to monitor the content posted by Participant’s in order to comment, respond, and monitor compliance with the foregoing. EB Productions shall have the right to edit, refuse to post, or remove any content whatsoever which it finds in its sole discretion to be in breach of any of the Terms and Conditions or in any way objectionable.

All statements, advice and opinions posted by Participant’s are those of such Participant’s only and are neither endorsed by, nor the responsibility of EB Productions.

The Participant agree to defend, indemnify and hold harmless EB Productions, and its affiliated companies, agents and officers from and against any claims, losses, costs and expenses occasioned by the Participant’s use of this website, or the Participant’s breach of any of the Terms and Conditions.

EB Productions collects personal information from Participants (“Participant’s Information”) in order to successfully run its competitions and better interact with Participants. This information should be voluntarily submitted by the Participant. EB Productions uses reasonable administrative, technical, personnel and physical measures to safeguard any Participant’s Information against loss, theft, disclosure, modification or any unauthorized use. EB Productions will not use the Participant’s Information for purposes different from the purpose for which it was submitted, or share the Participant’s Information with third parties that are not affiliated with EB Productions, unless the Participant’s permission to do so is obtained.
